Aquarium Banyoles Rental Bike Terms and Conditions

By confirming your booking, you agree to the following cancellation policy:

More than 14 days before the rental start time: You will receive a 90% refund of the total booking value.

14 days to 3 days before the rental start time: You will receive a 50% refund of the total booking value.

Less than 3 days before the rental start time: No refund will be issued.

No-shows: No refund will be issued.

Café Aquarium Bike Rental Agreement & Liability Waiver

1. Rider Declaration

By signing this agreement, I confirm that:

I have read and understood this Rental Agreement and Liability Waiver.

I am at least 18 years of age, or I am signing on behalf of a minor for whom I am legally responsible.

I am physically fit and capable of safely operating the rented bicycle.

I have sufficient experience to ride the type of bicycle I have rented.

I am not under the influence of alcohol, drugs, or any medication that may impair my ability to ride safely.

I will ride responsibly and within my own abilities.

2. Assumption of Risk

I understand that cycling is an outdoor activity involving inherent risks, including but not limited to:

Falls and loss of control.

Collisions with vehicles, pedestrians, cyclists, animals, or fixed objects.

Uneven road surfaces, gravel, potholes, loose stones, and other hazards.

Mechanical failures.

Weather conditions.

Physical exertion and fatigue.

I voluntarily accept these risks.

3. Rider Responsibilities

I agree to:

Wear a properly fitted helmet at all times while riding.

Obey all applicable Spanish traffic laws and regulations.

Ride with due care and consideration for other road users.

Use the bicycle only for its intended purpose.

Never allow another person to use the rented bicycle.

Stop riding immediately if the bicycle becomes unsafe.

4. Care of the Bicycle

During the rental period I agree to:

Take reasonable care of the bicycle and accessories.

Lock the bicycle whenever it is unattended using the lock provided.

Never leave the bicycle unattended overnight in a public place.

Not modify or dismantle any part of the bicycle.

Report any accident, theft, damage or mechanical issue to Café Aquarium as soon as reasonably possible.

5. Damage, Loss and Theft

I understand that I am responsible for:

Damage caused through negligence, misuse or failure to follow this agreement.

Loss or theft of the bicycle or accessories while they are under my responsibility.

Missing accessories including, but not limited to, locks, pumps, chargers, tools, helmets or pedals supplied by Café Aquarium.

Normal wear and tear resulting from proper use will not be charged.

6. Mechanical Problems

If a mechanical issue occurs, I will contact Café Aquarium before attempting any repair other than basic roadside adjustments necessary for safety.

Where reasonably possible, Café Aquarium will provide assistance or arrange an appropriate solution. However, delays caused by location, weather or circumstances beyond Café Aquarium's control may occur.

7. Accidents and Medical Care

If I am involved in an accident, I will seek appropriate medical assistance where necessary and notify Café Aquarium as soon as reasonably possible.

I understand that I am responsible for my own medical expenses unless otherwise covered by my own insurance.

8. Liability

To the maximum extent permitted by applicable law, I acknowledge that cycling involves inherent risks and I voluntarily participate at my own risk.

Café Aquarium shall not be liable for injury, death, loss or damage arising from the inherent risks of cycling or from the rider's own acts or omissions.

Nothing in this agreement excludes or limits any liability that cannot legally be excluded or limited under applicable law, including liability arising from gross negligence, wilful misconduct or other rights that consumers cannot waive under Spanish law.

9. Personal Property

Café Aquarium is not responsible for the loss, theft or damage of personal belongings left on the bicycle or at Café Aquarium's premises.

10. Insurance

I understand that the rental price does not include personal accident, medical or travel insurance unless expressly stated.

I acknowledge that I am responsible for ensuring I have appropriate insurance if I consider it necessary.

11. Cancellation Policy

I acknowledge that my rental is subject to Café Aquarium's Booking and Cancellation Policy, which I have read and accepted.

12. Data Protection

Personal information collected as part of the rental process will be processed only for booking, rental administration, safety, legal compliance and customer service purposes in accordance with applicable data protection legislation.

13. Agreement

By signing electronically, I confirm that:

I have read and understood this agreement.

I have had the opportunity to ask questions.

I voluntarily agree to all of the above terms.
